Data Centers and the Places They Land: What Municipalities Are Actually Wrestling With
Few construction topics have generated as much local heat in 2026 as data centers. Town hall meetings that used to draw a handful of residents are now standing-room-only. Zoning votes that would normally pass quietly are getting pushed back, tabled, or paused outright. And the debate isn't confined to any one region or political lean — it's showing up in Texas, New York, Michigan, Kansas, North Carolina, and dozens of places in between. This piece isn't about whether data centers are "good" or "bad." It's an attempt to lay out, as plainly as possible, what municipalities are actually weighing when a data center proposal lands on their desk — and why reasonable people keep landing in very different places on it.

The Scale of What's Happening
It helps to start with just how much building is underway. Over 4,500 active data center facilities in the U.S. now consume roughly 176 terawatt-hours of electricity annually — about 4.4% of all U.S. electricity — with more than 700 additional facilities currently under construction across 40 states. A January 2026 industry report projects that combined U.S. data center energy demand will nearly double between 2025 and 2028, rising from 80 to 150 gigawatts — roughly equivalent to adding a country with the electricity needs of Spain in just three years. This is happening because of the AI boom specifically. Hyperscalers — Microsoft, Amazon, Google, and Meta — are on track for roughly $364 billion in combined capital investment in 2025 alone, and that capital has to land somewhere physical, in someone's county.
The Case Made in Favor
The economic argument for data centers rests on a few pillars, and it isn't a fringe position — it's the case most state economic development offices and many local officials make. One industry-commissioned study estimated that a $100 billion data-center buildout could create roughly 500,000 direct and indirect jobs and add $140 billion to GDP over five years, and total government revenues tied to the data center sector nationally rose from about $66 billion in 2017 to more than $162 billion by 2023. There's also a competitiveness argument layered on top: supporters frame data center capacity as a bottleneck on AI development itself, treated increasingly as a matter of national economic and strategic importance — which is a large part of why states have historically competed with tax incentives to land these projects in the first place.
The Case Made Against
The concerns raised by residents and researchers tend to cluster around four issues, and they show up in nearly every local hearing.
Jobs don't match the construction hype. Communities often see a large temporary construction workforce, then a much smaller permanent one. Building a 250,000-square-foot data center can employ up to 1,500 local workers for 12 to 18 months during construction, but that number falls to around 50 full-time employees once the facility is operational — half of them contracted, according to a 2023 state-commissioned report from Virginia, the country's largest data center hub.
Electricity demand can push costs onto everyone else, not just the facility. Data centers can increase local utility rates by driving up overall demand, forcing utilities to invest in costly infrastructure upgrades that get passed on to residents through higher rates — and long-term power agreements signed by data center operators can reduce available supply and push up prices for other customers in the same market. This effect is regional, not uniform. In Virginia, data centers now account for more than 1 in 4 kilowatt-hours of the state's total electricity consumption, which is a very different reality than a state where data centers remain a small share of the grid.
Water use is a real local issue, even though it's a small national one. The two framings here genuinely aren't in conflict — they're describing different scales of the same problem. Direct U.S. data center water use totals around 17 billion gallons per year, roughly 0.3% of the public water supply nationally — but that national average masks real local strain, as in The Dalles, Oregon, where one company's water use grew 316% while the town's population grew only 12%. The most careful version of this debate concludes that the disagreement isn't really about the numbers — it's about whether the harms are diffuse and manageable at a national scale, or concentrated and genuinely severe in the specific watershed or utility service area where a facility actually gets built.
Tax incentives may not pay for themselves. Public infrastructure built to serve a data center — water systems, substations, transmission lines, roads — typically has to last around 30 years, and if a facility downsizes or relocates before those costs are recovered, the community can be left paying for infrastructure sized for a facility that no longer exists. That's a big part of why, as noted below, incentive packages that once passed with little debate are now getting a much harder look.
How Municipalities Are Actually Responding
The most visible trend in 2026 is the moratorium — a temporary construction pause used to buy time for a city or county to write rules that didn't exist before the applications started arriving. More than a dozen state-level moratorium bills have been introduced in 2026, but it's local governments that have moved fastest — dozens of municipalities have enacted local construction pauses, shifting the center of gravity of this fight toward city halls and county commissions rather than statehouses. One independent tracker had documented 15 formal public actions restricting or rejecting data center development across 10 states since 2025, including active moratoriums, outright project rejections, and new zoning ordinances.
This is playing out close to home, too. In July 2026, Fort Worth's Zoning Commission voted 7-4 to deny a first-of-its-kind proposed ordinance on data center regulation and send it back to City Council, with commissioners citing the need for more detail and stricter standards before moving forward — while residents at the meeting pushed for a full moratorium and argued data centers should be classified and regulated as heavy industrial use rather than light industrial. Similar fights have played out from Michigan to New York: Harvey County, Kansas voted in January 2026 to impose a data center moratorium running through the end of 2028, while the Town of Brookhaven, New York imposed an 18-month moratorium after a report of a planned large-scale AI facility drew significant public backlash over water consumption, noise, and grid strain concerns.
What's notable is that these actions rarely split along predictable political lines. Legal analysts who track these disputes note a common pattern regardless of a community's politics: the developers and municipalities that fare best tend to be the ones that treat residents as a party to genuinely engage with, rather than an obstacle to route around.
The Actual Disagreement, Distilled
Strip away the noise, and most data center fights come down to a handful of specific, answerable questions rather than a single yes-or-no verdict on the technology: Does this specific site have the water and grid capacity to absorb this specific facility without shifting costs onto existing ratepayers? Is the proposed tax incentive package structured so the public infrastructure investment actually pays for itself over the facility's real lifespan? Is the zoning classification (light industrial vs. heavy industrial) appropriate for the noise, traffic, and utility footprint involved? And has the community had a genuine seat at the table before the deal was largely finalized?
Those are the questions municipalities are actually working through — not "should this industry exist," but "does this particular project, on this particular site, with these particular terms, make sense for this particular community." That's a much harder conversation to have well, but it's the one actually happening in city council chambers this year.
